Can I Build a Pool Without Council Approval? The NSW Guide

Summer is coming, and the idea of a backyard pool is becoming very tempting. But before you buy the tiles or book the excavator, you need to deal with the paperwork.

A common myth in NSW is that “if it’s just a pool, I don’t need approval.” In reality, almost all swimming pools require approval, whether it’s a concrete in-ground pool, a fibreglass shell, or even a large above-ground spa.

The good news is that, just like granny flats, pools can often be fast-tracked. This guide explains the rules for building a pool in NSW and how to get swimming sooner.


The Golden Rule: Yes, You Need Approval

In NSW, any excavation or structure that can hold more than 2,000 litres of water generally requires approval. Considering even a small plunge pool holds much more than that, the answer is almost always yes.

You also need approval for the safety barrier (pool fence). This is strictly enforced in NSW to prevent child drownings.

Just like home builds, you have two paths:

  1. CDC (Complying Development Certificate): The fast track.

  2. DA (Development Application): The standard council path.


The Fast Track: CDC for Pools

If your site allows it, a CDC is the best way to go. It can be approved by a private certifier in weeks. To qualify, your pool design typically needs to meet these specific rules (under the state SEPP code):

  • Rear Setback: The water must be at least 1.0m from the rear boundary (and the fence can’t rely on the neighbour’s fence unless specific standards are met).

  • Side Setback: The water must be at least 1.0m from the side boundary.

  • Decking Height: Any surrounding deck cannot be more than 600mm above the ground (if it’s higher, it creates privacy issues).

  • Location: It generally must be in the rear yard (not the front yard).

  • Heritage & Trees: You cannot remove “significant” trees, and heritage restrictions may apply.

Pro Tip: The “1.0m setback” is for the water. Structural beams or coping tiles might need to be set back even further depending on the height.

You will need to lodge a Development Application (DA) with your council if:

  • You have a small block: And you need to build the pool closer than 1.0m to the fence.

  • Your block is sensitive: It is in a heritage conservation area, on bushfire-prone land (Flame Zone), or environmentally sensitive land.

  • Tree Removal: You need to remove a protected tree to fit the pool in.

A DA takes longer (3-6 months), but it gives you the flexibility to argue your case (e.g., “I need to put the pool here because it’s the only sunny spot”).


The “Hidden” Hurdles: Sewer & BASIX

Getting the pool approved is one thing, but there are two technical checks that often trip homeowners up:

1. Sydney Water (The “Zone of Influence”) Many backyards in Sydney have a sewer main running through them. You cannot simply dig a hole over a sewer pipe.

  • If your pool is near a pipe, you will need a “Building Over Sewer” endorsement.

  • We may need to design “concrete encasement” for the pipe to protect it from the weight of your pool.

2. BASIX (Energy Efficiency) Yes, pools need a BASIX certificate too! If your pool holds more than 40,000 litres, or if you have a pump and heater, you must meet energy and water targets. This usually means you will need a pool cover and a rainwater tank top-up system.


Don’t Forget the Fence!

The most critical part of your pool approval is the Child Resistant Barrier. NSW laws are incredibly strict here.

  • Gates must open outwards (away from the pool).

  • Gates must be self-closing and self-latching.

  • The “Non-Climbable Zone” (NCZ) means you cannot have trees, BBQs, or pot plants near the fence that a child could use as a ladder.
